These Terms of Service ("Terms") govern your use of Keep the Archive.
By creating an account, purchasing an Archive, contributing content, claiming an Archive, or otherwise using the service, you agree to these Terms.
If you do not agree, please do not use Keep the Archive.
1. About Keep the Archive
Keep the Archive is a private digital keepsake service that allows adults to collect and preserve messages and paper-based memories for teachers.
A Host may create an Archive, invite other adults to contribute, and designate a Recipient. After the applicable reveal date, the Recipient may access the Archive and continue adding memories.
2. Adult Use
Keep the Archive is intended for adults.
You must be at least 18 years old to create an account, purchase an Archive, or independently submit content through the service.
Keep the Archive is not intended for children to create accounts or independently submit personal information.
3. Accounts
You are responsible for providing accurate account information and maintaining the confidentiality of your login credentials.
You may not access another person's account without authorization.
We may suspend or restrict an account when reasonably necessary to protect users, investigate abuse, enforce these Terms, or secure the service.
4. Creating an Archive
A Host is responsible for providing reasonably accurate information when creating an Archive, including the intended Recipient's information.
Hosts should review the Recipient email address carefully. Until an Archive has been claimed, certain Recipient information may be editable.
A private contribution link may be provided for an Archive. Hosts are responsible for sharing that link only with people they intend to invite.
5. Contributions
A valid contribution link allows an invited adult to submit content to the applicable Archive.
It does not provide permission to view other contributions.
Contributors must provide attribution in the "Who is this from?" field and may submit eligible content such as:
- typed messages
- handwritten notes
- cards
- drawings
- artwork
- doodles; and
- photographs or scans of similar paper-based keepsakes.
For the current version of Keep the Archive, do not upload photographs depicting students or other children.
6. Your Content
You retain any ownership rights you have in content you submit.
By submitting content, you give Keep the Archive a limited, non-exclusive license to host, store, process, reproduce, display, and transmit that content only as reasonably necessary to operate, secure, maintain, and provide Keep the Archive and its related features.
You represent that you have the rights or appropriate permission necessary to submit the content and permit Keep the Archive to process it as described in these Terms and our Privacy Policy.
Submitting content does not give Keep the Archive ownership of your content.
7. Prohibited Content and Conduct
You may not use Keep the Archive to submit or distribute content that:
- is unlawful
- is threatening, harassing, hateful, or abusive
- sexually exploits or endangers a minor
- contains malicious software
- violates another person's intellectual property or privacy rights
- contains highly sensitive information unnecessary for the purpose of the Archive
- depicts students or other children in photographs in violation of our current Content Rules
- impersonates another person
- is submitted without appropriate permission; or
- otherwise abuses or interferes with the service.
You may not attempt to:
- gain unauthorized access to an Archive
- guess or systematically discover private Archive links
- circumvent reveal dates or access restrictions
- scrape Archive content
- interfere with the service
- upload malicious files; or
- use Keep the Archive for spam or other abusive activity.
We may remove content or restrict access when reasonably necessary to enforce these rules.
8. Privacy and Private Links
Archive content is intended to be private, but users are also responsible for protecting private contribution links and account credentials.
Do not publicly post an Archive contribution link unless you intend to allow anyone who obtains the link to submit content.
Our handling of personal information is described in our Privacy Policy.
9. Reveal Dates
Archive content may remain inaccessible to the Recipient until the Host-selected reveal date.
Technical issues, account verification, inaccurate Recipient information, or circumstances outside our reasonable control may delay access.
Keep the Archive does not guarantee delivery or access at an exact time of day.
10. Purchases
Keep the Archive is intended to be offered as a one-time purchase at the price displayed at checkout.
Payment will be processed through a third-party payment processor.
Purchasing one Archive provides the right to create and use the specific Archive associated with that purchase. It does not provide unlimited creation of additional Archives.
Applicable taxes, if any, may be added as required.
11. Refunds
You may request a full refund within 7 days of purchase if the Archive has not yet received any contributions.
Once an Archive has received its first contribution, the purchase is generally non-refundable because the service has begun storing and managing content for that Archive.
If you were charged more than once, experience a technical problem that prevents you from using the service, or believe there has been an error with your purchase, contact us at hello@keepthearchive.com and we'll review the issue.
Nothing in this policy limits any refund or cancellation rights required by applicable law.
12. Availability and Changes
We work to keep Keep the Archive available and reliable, but we cannot guarantee uninterrupted or error-free operation.
We may modify, maintain, update, suspend, or discontinue features when reasonably necessary.
If a change materially affects a paid Archive, we will take reasonable steps to minimize disruption.
13. Long-Term Storage
Keep the Archive is designed for long-term keepsake storage, but no digital storage service should be treated as the only copy of irreplaceable material.
We intend to make Archives available for long-term access after reveal. Because Keep the Archive relies on third-party hosting and storage services, we do not guarantee indefinite availability or storage. If we discontinue the service or materially change our storage offering, we will make reasonable efforts to provide advance notice and an opportunity to download available Archive content.
We may provide export or backup functionality in the future, but such functionality is not guaranteed unless expressly included in the purchased service.
14. Removal and Termination
We may remove content or suspend access when reasonably necessary because of:
- violation of these Terms
- unlawful activity
- security concerns
- abuse
- valid legal requests; or
- risk to users or the service.
Users may contact us to request eligible account or content deletion.
15. Intellectual Property
Keep the Archive's software, branding, visual design, text, logos, and other service materials are owned by or licensed to Keep the Archive and are protected by applicable intellectual property laws.
These Terms do not grant users ownership of Keep the Archive's platform or branding.
16. Disclaimers
Keep the Archive is provided on an "as available" basis to the extent permitted by law.
We do not guarantee that the service will always operate without interruption, that every uploaded file will remain recoverable indefinitely, or that every user will use the service appropriately.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
17. Limitation of Liability
To the maximum extent permitted by applicable law, Keep the Archive and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the service.
18. Governing Law and Disputes
This section will be finalized based on Keep the Archive's legal operating entity and jurisdiction before broad public launch.
19. Changes to These Terms
We may update these Terms from time to time.
Material changes will be communicated where appropriate, and the Effective Date will be updated.
